JUDGMENT 

Plaintiff’s claim per the endorsement on his writ of summons is as follows: 

a. A declaration that the interdiction of the Plaintiff by the Defendant  from 1994 to date is unlawful. 

b. An order directed at the Defendant to re-instate the Plaintiff 

c. An order for payment of all his salary and allowances from the date  of interdiction to date, due Plaintiff. 

d. Interest on all monies found due from Defendant to Plaintiff. e. Damages 

f. Any other order(s) as this Court may deem just and equitable.

In its statement of defence, Defendant pleaded that Plaintiff’s action is statute  barred hence the issue whether or not the instant suit is statute barred. At the  application for directions, the court ordered parties to file written legal  arguments for this issue to be determined in the preliminary. Plaintiff failed to file his legal argument but Defendant did.
