BULKACHUWA JCA (Delivering the Lead Judgment): By a writ of summons filed on the 31st of July before the Federal High Court coram Egbo-Egbo J., the 1st respondent as plaintiff claimed against the appellant/ defendant and the other set of respondents as defendants the following declaratory and injunctive reliefs;
i. A declaration that the public statement credited to the defendants to the effect that he, Chief Chris Uba, be prosecuted for treason by reason of the resignation of Dr. Chris Ngige as the Governor of Anambra State, and the political crisis in Anambra State constitutes a threat to the life and liberty of the plaintiff, and it is unconstitutional, null and void.
ii. A declaration that the actions of the 4th defendant in consequence of the statements of the 1st - 3rd defendants seeking judicial order to cause the arrest, imprisonment and prosecution of the plaintiff on grounds of rumours and speculation is a threat to the life and liberty of the plaintiff contrary to sections 3…
