JUDGMENT OF BENIN J.A
There are two reliefs indorsed on the plaintiff's writ of summons. These are: (1) a declaration that the closure of the plaintiff’s letter box is wrongful; and (2) damages. In support of these reliefs, the plaintiff averred that he rents a letter box from the defendant, for which he paid the rent for 1994. He averred further that the defendant closed down this letter box for over one month, ostensibly for non-payment of rent. As a result of this unlawful closure, the plaintiff lost communication with the outside world. Besides, the plaintiff lost a lot of business contacts and suffered extensive damages as a result of this I closure, the statement of claim concluded.
In its statement of defence, the defendant averred that the plaintiff’s letter box was not one of those listed for closure since he had paid his rent already.
