BA’ABA, JCA: (Delivering the Lead Judgment): This is an interlocutory appeal against the ruling of the Edo State High Court, sitting at Benin City Judicial Division delivered on the 25th day of May, 2000. The plaintiff/ respondent instituted an action against the defendants/appellants in the trial court, claiming: “(a) A declaration that the defendant rectifies the defects in the contract agreement to enable the execution by the parties.
(b) A declaration that the plaintiff still is and remains the proper tenant to the defendant who should be paid agreed rent for a period of time to be extended from 2 years to 5 years as agreed upon by the parties.
