SANGA JCA (Delivering the Lead Judgment): On 1 April 2015, when this appeal was called up for hearing, parties were absent. G. O. Bright Esq. appeared for the appellant holding thebrief of C. N. Nwapi Esq. A. M. Ekadi Esq., appeared for the 1st to 4th respondents, while G. I. Abibo Esq. (SAN) appeared for the 5th to 7th respondents leading: A. A. Abo Esq., C. E. Eze(Miss) and C. S. Maduba Esq. There was no appearance for the 8th, 9th and 10th respondents. The registrar told the court that the 8th, 9thand 10th respondents were served with hearingnotice on 25 March 2015, and their counsel C. S. Owoboki Esq. was aware of the date of adjournment. Upon confirming that parties were served the court allowed counsel to make their submissions. G. O.
