HABEEB ADEWALE OLUMUYIWA ABIRU, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment of the High Court of Kaduna State in Suit No KDH/KAD/717/2000 delivered by Honorable Justice AbdulKadir A. Othman on the 28th of October, 2010. The records of appeal show that the original plaintiff in this matter was one Maiungwa Umaru Mudu and that he has since died and was substituted with the present Appellant while the original first defendant was one Mallam Sadiq Adamu and he, too, upon his death was substituted with the present first Respondent. By an amended statement of claim dated the 8th of December, 2003, the Appellant, as plaintiff, claimed against the Respondents, as defendants, for:
i. A declaration of title to the farmland lying being and situate at Ungwan Gimbiya/Ungwan Malamai Sabon Tasha, Kaduna in the Chikun Local Government Council of Kaduna State.
