UWAIFO, J.C.A. (Delivering the Leading Judgment): There are some interlocutory proceedings, from my experience, which achieve nothing other than the delay of justice. This becomes even more apparent when appeals are pursued from their outcome. The present application is intended to bring to this court an appeal from a ruling of D. O. Edozie, J., delivered on 10 May, 1989 at the Enugu High Court. The motion was filed on 10 January, 1990 and seeks an enlargement of time within which to appeal from that ruling.

In the court below there is an action against the applicants and one Thomas Ozioko, the driver of their commercial vehicle, a Nissan bus registered as No. AN1281EC. The action is for damages arising from a fatal accident while the said driver was plying the vehicle in the course of his employment. The plaintiff had already concluded evidence in his case when an application to amend the statement of defence was brought by the 1st and 2nd defendants (who are the present applicants).
