RAPHAEL CHIKWE AGBO, J.C.A.: (Delivering the Leading Judgment): The appellant was the first accused person in charge number KWS/14C/2011 which charge read thus:

COUNT 1:

That you Segun Abayomi (M), Leke Ojo (M) on or about the 19th June 2009 along Asa Dam road highway in Ilorin, Kwara State within the jurisdiction of this Honourable Court while armed with short cutlass conspired to carry out an illegal act to wit; to rob Adam Akinsola the driver of Taxi cab, a Mitsubishi Lancer Car with Reg. No. XC 775 FFA and you thereby committed an offence punishable under section 97 of the Penal Code Law Cap P4 Laws of Kwara State and Section 1(2) of Robbery and Fire Arms (Special Provision) Act, CAP R11 Laws of Federation of Nigeria 2004.

COUNT 2:
