UZO IFEYINWA NDUKWE-ANYANWU, J.C.A. (Delivering the Leading Judgment): This is an appeal against the Ruling of the High Court of Ondo State, Akure Judicial Division delivered on the 11th March, 2014 by Hon. Justice A. O. Odusola.

A resume of the facts culminating in this appeal is hereby made as follows: The Appellant, Suleiman Ogirima Azeez and two others namely Jimoh Mohammed and Anamoh Muritala were arraigned before the Ondo State High Court, Akure Judicial Division on a two count Information of Conspiracy to commit Armed Robbery and Armed Robbery. The said offences being contrary to Section 6(b) and 1(2)(b) of the Robbery and Firearms (Special Provisions) Act, Cap R11, Laws of the Federation of Nigeria, 2004.

They all pleaded "Not Guilty" to the two counts, thus putting the Prosecution to the proof of the offence charged. The Prosecution called three (3) witnesses in proof of the offence and tendered exhibits in support of its case.
