FABIYI JCA(Delivering the Lead Judgment): This is an appeal against the decision of the NationalAssembly/Governorship and Legislative Houses Election Tribunal holden at Owerri, Imo State of Nigeria with Oniyangi J. as Chairman. The petition which was filed by the appellant herein against the respondents, after a full hearing, was dismissed on 2nd day of April, 2004.

It is apt to state it here that election to place adequate persons on vacant seats in the Senate of the Federal Republic of Nigeria was conducted on 12th April, 2003. The appellant herein and petitioner at the Tribunal, contested the election on the platform of the United Nigeria Peoples Party (UNPP for short) while the 1st respondent contested under the banner of the Peoples Democratic Party (PDP for short). Seven other parties fielded candidates at the election. The contest was in respect of the senatorial seat in the Imo North (Okigwe) Senatorial District.
