(Delivering the Lead Judgment): This is an appeal against the judgment of the Court of Appeal delivered on 21st day of December, 2018, in Appeal No. CA/K/302c/C/2018 wherein the appeal of the Appellant was dismissed and the judgment of the trial Court convicting and sentencing the Appellant to death by hanging was affirmed.
BRIEF STATEMENT OF FACTS
On the 17/07/2012, the Appellant (together with 8 others) were arraigned before the trial Court on 3 counts contained in the Amended Charge Sheet dated the 14/01/2013 and the counts read thus: -
