JAMILU YAMMAMA TUKUR, JSC (DELIVERING THE LEADING JUDGMENT):This appeal is against the judgment of the Court of Appeal, Abuja Division (the lower Court), delivered on 27/03/2026 in Appeal No. CA/ABJ/CV/126/2026, wherein the Court affirmed in part the judgment of the Federal High Court, Abuja (the trial Court), delivered on 19/01/2026 by Hon. Justice Emeka Nwite.
STATEMENT OF FACTS
The facts of the case, briefly stated, are that the Plaintiff (now Appellant) commenced proceedings by way of Originating Summons, challenging the primary election of the Social Democratic Party (2nd Respondent) for the forthcoming Ekiti State Governorship Election in Ekiti State on the ground that no primary election was conducted in Ado Ekiti to nominate or elect the 3rd Respondent as the candidate of the 2nd Respondent for the said governorship election. The trial Court, after listening to the parties, entered judgment in favour of the Respondents and dismissed the Appellant's case.
