ABIMBOLA OSARUGUE OBASEKI-ADEJUMO, J.C.A. (Delivering the Leading Judgment): This is an appeal against the decision of the Lagos State High Court delivered on 2nd July, 2013, coram DADA J., in respect of suit No:LD/1524/2006 wherein the issue before the Court was in respect of who had a better title to land between the 1st Respondent/claimant who derived her title from one Mr. Patrick Amaefule; who she also claimed derived his title from the 4th Respondent/4th defendant of Imam family and the 2nd and 3rd Respondents/2nd and 3rd defendants who claimed to have derived their title from the Appellant/1st defendant, the head of the Dada Bakare family. The land in question is at Abijo village, Lekki-Epe Express Way, Lagos State. After the trial, the Lower Court found in favour of the 1st Respondent and granted damages against the 1st 3rd defendant, N500,000 as damages for trespass and N250,000 as cost against them.
