OYEBISI FOLAYEMI OMOLEYE, J.C.A.(Delivering the Leading Judgment): This is an appeal against the decision of the High Court of Adamawa State (hereinafter referred to as the trial Court) in Suit No: ADSY/110/2016 delivered on the 29th of November, 2016 per H. N. Hammanjoda, J.
The background facts of this matter are that at the trial Court, the Appellant as Plaintiff by a Writ of Summons and Statement of Claim dated the 27th of July, 2016 filed on the 5th of August, 2016 claimed against the Respondents herein as defendants jointly and severally as follows:
i. The balance of N14,321,000.00 (Fourteen Million Three Hundred and Twenty One Thousand Naira only) arising from printings and supplies made by the Plaintiff to the Defendants.
ii. N5,000,000.00 (Five Million Naira) General Damages.
iii. Costs of the suit.
