MUHAMMAD IBRAHIM SIRAJO, J.C.A. (Delivering the leading Judgment): By an originating motion filed on the 27th day of June, 2022, the Applicants/Appellants brought an action against the Respondent before the High Court of Bayelsa State, Yenagoa Judicial Division (the lower Court), Coram: E. G. Omukoro, J., in Suit No: YHC/132M/2022, for the setting aside of an arbitral award made by the Bureau for Co-Operative Development, Yenagoa, Bayelsa State in terms of the following reliefs:

1. An order setting aside the Arbitration Award of the Bureau for Co-Operative Development, Yenagoa, Bayelsa State, given in favour of the Respondent against the Applicants, dated the 15th day of December, 2021.

2. And for such further or other orders as this Honourable Court may deemed fit to make in the circumstances.

Upon the service of the originating processes, the Respondent filed two counter affidavits and a preliminary objection in opposition to the action.
