ADEMOLA SAMUEL BOLA, J.C.A. (Delivering the Leading Judgment): This appeal stems from the ruling of the Federal High Court, Uyo Division holding at Uyo delivered by Hon. Justice A. A. Okeke on the 8th day of March, 2021 in Charge No FHC/UY/59C/2019 wherein the trial Court overruled the No Case Submission made by the Appellant at the close of the prosecution's case. Being dissatisfied with the ruling of the trial Court, the Appellant with the leave of the lower Court appealed against the ruling by filing a notice of appeal dated and filed on 22nd March, 2021.

The records of appeal were transmitted to this Court on 29th March, 2021. The Appellant's brief of argument was filed on 8th April, 2021. The Respondent's brief was filed on 22nd June, 2021. The reply brief of the Applicant was filed on 25th June, 2021.
