SANUSI, JCA: ( Delivering the Lead Judgment): This is an appeal against the decision of Bauchi State High court of Justice delivered on the 18th of May, 1998 by Hon. Chief Judge of the State, Darazo C. J. The respondent who was trading under a business name and style of “GAKSMAT ENGINEERING ENTERPRISES” as plaintiff at the lower court took a writ against the appellant as defendant thereat on the Undefended list, claiming the sum of Two Hundred and Fifty Eight Thousand One Hundred and Twelve Naira Fifty Six Kobo (#258,112:56) being balance of a contract sum for job executed, to wit, internal work of the Luman-Katagum Electrification and repairs of Poyand Diesel Generator/control panels and 110 vol. 15 charge control systems generator, the total cost of which totalled up to N770,280:56K. Of the total contract sum a down payment of N462,168:00 was made by the appellant, leaving the balance being claimed as mentioned above.
