(Delivering the Leading Judgment): The Appellants were the defendants in suit No. BA/202/2006, same commenced by the plaintiffs/respondents vide originating summons at the High Court of Justice Bauchi State. In the Judgment delivered on 2nd October, 2013 the Court below (coram B.G. Sanga J as he then was) entered Judgment in favour of the respondent.

The brief facts of the case as presented by the Appellants, leading to this appeal are that, Respondent was a member of the Bauchi State House of Assembly representing Kirfi Constituency of Bauchi State to serve a term of four years from May 2003 to May 2007. On 9th November, 2006, the Respondent in a unanimous voice vote by the members of the Bauchi State House of Assembly, resolved to suspend him from the House for three months with effect from 9th November, 2006 and was given a letter to that effect on the 13th November, 2006.
