CHIOMA EGONDU NWOSU-IHEME, JSC (DELIVERING THE LEADING JUDGMENT): This appeal arose from the decision of the Court of Appeal, Yola Division delivered on the 9th day of October, 2020 in Appeal No. CA/YL/35CN/202 [coram: Hon. Justice Chidi Nwaoma JCA, Hon. Justice James Shehu Abiriyi JCA and Hon. Justice Abdullahi Mahmud Bayero, JCA] dismissing the Appellant's appeal and upholding the judgment of the trial Federal High Court, col-am Hon. Justice A.M. Anka delivered on 6th day of February, 2020.

The Appellant and four other accused persons were investigated by the Independent Corrupt Practices and Other Related Offences Commission on allegations of conspiracy and being in possession of counterfeit bank notes of N1000 (One Thousand Naira) denomination in different values contrary to the Counterfeit Currency (Special Provisions) Act Cap. C35, LFN 2004. The Charge against the accused persons are as follows:
