MUHAMMED LAWAL SHUAIBU, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment of Kebbi State High Court sitting at Birnin kebbi delivered by Hon. Justice Ibrahim Kangiwa on 31/03/2014. The appellant was found guilty and convicted for the offences of culpable homicide punishable with death and armed robbery contrary to Sections 221 (b) of the Penal Code and 1 (2) (a) of the Robbery and Firearms (Special Provisions) Act Cap 398 Laws of the Federation 1990 (as amended). He was accordingly sentenced to death on each. The two counts charge for which the appellant was arraigned, tried, convicted and sentenced read as follows:
