YARGATA BYENCHIT NIMPAR, J.C.A. (Delivering the Leading Judgment): This appeal is against the judgment of the National Industrial Court sitting in Lagos and delivered on the 6th of July, 2012, and delivered by HON. JUSTICE O. A. OBASEKI-OSAGHAE wherein the lower Court dismissed the claim of the Appellant. Aggrieved with the decision, the Appellant filed a Notice of Appeal dated 28th August, 2012 filed same day setting out 9 grounds of Appeal.
The Appellant by way of a general complaint filed at the lower Court sought the following reliefs:
a) A DECLARATION that the summary Dismissal of the Claimant by the Defendant vide letter dated 14th day of October, 2011 is wrongful and unlawful.
