ODUYEMI, JCA (Delivering the Lead Judgment): By a motion ex-parte filed in the High Court of Justice of Kogi State on 28th November, 1996, the appellant herein, as applicant in the said High Court sought against the 1st and 2nd respondents in this appeal:-

An order granting leave to the applicant to apply for an order of mandamus to compel the Chairman of Yagba-East Local Government to carry out a public duty imposed on him by the Kogi State Government Guidelines on the Appointment of Ward/Village/District Heads/ Gaagos/Baales viz: issuing a letter of appointment as Baale of Ejuku, to the applicant. An order of interlocutory injunction to restrain the chairman and members of the Yagba-East Traditional Council from convening a meeting to reopen, alter, change their endorsement, A approval and recommendation of Alhaji Braimoh Simidu Bisimilahi as the Baale of Ejuku from Oke-Aiyegunle ward as contained in their Minutes of Meeting of 19th September, 1996, pending the determination …
