RULING 

This is a ruling in respect of a motion on notice filed on behalf of the 1st defendant/applicant for an order striking out the writ of summons and  statement of claim filed by the plaintiff and a further order dismissing  the suit. The background to this case is that:  

The Plaintiff/respondent, a body incorporated on 26/1/16, caused to be  issued out of the registry of this Court a writ of summons and a  statement of claim against the defendant/applicant herein and 2 others for the following reliefs: 

a. An order declaring the plaintiff’s title to the entire Achimota School  land including the 172.68 claimed by the 1st and 2nd defendants  pursuant to the judgment entered in Suit No. SOL 21/10. 

b. An order setting aside the judgment and all consequential orders,  entered in suit No. SOL 21/10 on the ground that the said  judgment and orders were obtained by fraud perpetrated on the  plaintiff by the 1st defendant, OR in the alternative, a declaration  that the judgment and all or…
