JUMMAI HANNATU SANKEY, J.C.A.(Delivering the Leading Judgment):This Judgment is predicated on an Appeal filed against the Judgment of the Federal High Court, Lagos in Suit no. FHC/L/CS/912/04, delivered on 24th June, 2005 by Abubakar, J. in favour of the Respondents (as Plaintiffs).

The suit had been commenced by the Plaintiffs (now Respondents) vide an Originating Summons dated and filed on 4th October 2004, seeking the determination of the following question:

WHETHER, having regard to the provisions of paragraph 4 of Nigerian Industrial Development Bank Administrative Order No.31/92, the plaintiffs are not entitled to retirement benefits.

ALTERNATIVELY

WHETHER the defendant in computing the terminal benefits of the plaintiffs complied with the provisions of paragraph 3 of the Nigerian Industrial Development Bank Administrative Order No.31/92 with respect to the disengagement notices and the benefits incidental thereto.''
