RAPHAEL OLUFEMI ROWLAND, J.C.A. (Delivering the Leading Judgment): The petitioner now Appellants brought a five paragraphs petition filed on the 19th December 1998 before the Local Government council Election Tribunal No.2 of Zamfara state holden at Gusau. The petitioners/Appellants Usamatu Mohammed Gurbin Bore and Abubakar Rafi in their petition challenged the return of Abubakar Sa'adu Zurmi and Abubakar Yan Musa, 1st and 2nd Respondents respectively as Chairman and vice Chairman elect for Zurmi Local Government council in the Local Government Election held on the 5th day of December, 1998.

The Independent National Electoral commission (INEC) was also sued as the 3rd Respondent in this action.

The respondents were said to have been returned with 12,122 votes against 9,379 votes said to be scored by the petitioners/Appellants.

The grounds of the petition are legion and at the end the petitioner prayed the lower tribunal for the following reliefs:-
