OMAGE JCA (Delivering the Lead Judgment): This is an appeal against the judgment/rulingof S. J. Idah of the Federal High Court sitting at Abuja. The ruling was delivered on 1st June, 2004, and it reads in part as follows “the facts available in this case are clearly showing that this appellant was arrested and detained by the police the (arrest) and detention of the applicant was sequel to the complaints of the 1st respondent as evidenced by exhibit 1. Exhibit 1 was the letter from the office of the secretary to the Borno State Government and it was dated 10th June, 2003. The letter “directed the Commissioner of Police as follows “in the light of the development, I am further directed to request your exalted office to arrest them (applicant and another) and investigate the matter with immediate effect.” The matter, the Commissioner of Police was directed to arrest and detain the respondent in this appeal for is the allegation of the unlawful transfer by the respondent now, then th…
