STEPHEN JONAH ADAH, JCA (Delivering the Leading Judgment): This appeal is against the decision of the Federal High Court sitting in Abuja in Suit No: FHC/ABJ/CS/281/2012, delivered on the 23rd day of February, 2016, by E.S. Chukwu, J.
This case was originated by the Respondent who as the Plaintiff took out a Writ of Summons against the Appellant as Defendant at the lower court. The Writ of Summons was taken out on 17th day of May, 2012, and sought the determination of one question and the reliefs sought, thus:
An Order of Court directing the defendants to release the plaintiffs' luggage weighing 32KG and deliver same to the plaintiff in good condition with all the items intact.
OR
An Order directing the defendants to pay E2,247.56,00 to the plaintiff being the cost of the items in the bag.
Special damages in the sum of E2, 34897 and 1, 947.00 U.S Dollars
10% interest on the judgment sum from the date of judgment to the date of satisfaction of the judgment sum.
