UGOCHUKWU ANTHONY OGAKWU, J.C.A. (Delivering the Leading Judgment): This appeal is against the decision of the Federal High Court Lagos Division delivered on 17th November 2009 in SUIT NO. FHC/L/CS/385/2009: Crescent Africa (Ghana) Limited v. Bronwen Energy Trading Limited. In the said decision of the lower Court, the Appellant's applications to set aside the decision of the lower Court ordering the registration of the foreign judgments the Respondent obtained against the Appellant were dismissed. The background to this appeal are as follows.
Upon the application of Respondent, the lower Court on the 5th day of May 2009 made an order registering as a foreign judgment, the judgment which the Respondent obtained against the Appellant on 24th May 2007 at the Superior Court of the Judicature, High Court of Justice, Commercial Division, Accra, Ghana in Suit No. BDC 97/2006.
