UGOCHUKWU ANTHONY OGAKWU, JCA (Delivering the Leading Judgement): This appeal is against the judgment of the High Court of Borno State in SUIT NO. BOHC/KDG/CV/08/2018: KUMA YERIMA and ORS. v. BULAMA ENEE. The Respondents herein were the Claimants at the lower court and by their Amended Statement of Claim they claimed the following reliefs:

“WHEREOF the claimants claims [sic] as follows:

a. A declaration that the claimants are the rightful owner of the farm in Wave village of Damboa Local Government Area of Borno State from south to north and 6km from east to west and bounded from the east with the farm of Alhaji Zauzauma, on the west is a high land, from the north Modu Indi’s farm as well as river and in the south is Bawa village community.

b. A declaration that the defendant act of entry or allocating the portion in their farm land to someone or remaining on the claimants’ land amount to the tort of trespass.
