(Delivering the Leading Judgment): This appeal was lodged against the judgment of the National Industrial Court (the lower Court), sitting in Lagos, delivered on August 10th, 2011, Coram F.I. Kola-Olalere, J., O.A. Obaseki-Osaghae, J., and J.T. Agbadu-Fishim, J., wherein the case of the Appellants was dismissed.
The facts leading to the appeal may be summarized in this manner: There was a contract of employment between the Appellants and the Respondent, upon which the Appellants served the Respondent in various capacities until their respective contracts of employment were determined by the Board of the Respondent. The Appellants contend that upon termination of their employment, the Respondent short paid in respect of their gratuities and pension.
