GUMEL JCA (Delivering the Lead Judgment): This is an appeal against the decision of the Akure Division of the Federal High Court, per Akanbi, J delivered on 30 January 2007, in suit number FHC/AK/CS/126/003. In a writ of summons dated 24 September 2003 and filed on 29 September 2003, the appellant, as the plaintiff, sought for the following reliefs against the respondent, as the defendant. They are: The sum of N3,988,531.12 (three million, nine hundred and eighty-eight thousand, five hundred and thirty-one naira, twelve kobo) beingoutstanding feesfor consultancyservices rendered by the plaintiff to the defendant between 1998 - 2001 and which the defendant has failed, refused and/or neglected to pay despite repeated demands ; N500,000.00 (five hundred thousand naira) general damages; and 21% interest from the date the money became payable to theplaintiff to the date of judgment and 10% interest from the date of judgment and the judgment sum is liquidated.
