MANGAJI, JCA (Delivering the Lead Judgment): This is an appeal against the ruling of Damulak, J. sitting in the High Court of Justice, Plateau State in suit No. PLD/J/118/96 dated 5/6/98 wherein he entered judgment against the appellants as defendants on an application under the undefended list procedure. The judgment sum awarded to the respondent as plaintiff is N24,836,387.12 together with interest on the said sum at the rate of 21% per annum from 26th January, 1998 until judgment and thereafter, at the same rate of 21% until total liquidation. The appellants were dissatisfied with the judgment and therefore applied to the trial court by a motion on notice praying that the judgment be set aside on some grounds that will later in this judgment be set out. That motion was heard and in a reserved ruling dated 17th December, 1999 the same was dismissed as lacking merit.
