ODUYEMI, JCA (Delivering the Lead Judgment) : By a writ of summons issued out of the Abuja Judicial Division of the Federal High Court on 10th January, 2000, the plaintiff - now respondent in this Court, claimed against the defendant - (appellant in this court) as follows:
“i. A declaration that the dismissal of the plaintiff by the defendantas contained in a letter Ref. No. PERS/SRO/DISM/CF - 1450/ Vol. l/95 dated October 13, 1999 from the services of the defendant is made (sic) and void and of no effect whatsoever.
ii. A declaration that the plaintiff is still in the services of the Central Bank of Nigeria and entitled to his rights, privileges, benefits and entitlements, and all others attached to his office from the purported date of suspension and dismissal until he attains his age of retirement.
iii. A declaration and an order directing the defendant to reinstate the plaintiff further with (sic) to his office with all his rights, privileges, promotions, allowances from the…
