AGBO, J.C.A. (Delivering the Leading Judgment): The 1st respondent obtained a money judgment against the 2nd and 3rd respondents in the High Court of Imo State. In order to execute the said judgment, the High Court of Imo State on 1st November, 2012 granted a garnishee order nisi attaching the sum of N28.1 Million belonging to the 2nd and 3rd respondents lodged with the appellant. Upon service of the decree nisi on the appellant, it filed a motion of preliminary objection challenging the competence of the High Court to entertain the garnishee proceeding. On 25-4-2013 the Imo State High Court dismissed the objection and made absolute the garnishee order.
Not satisfied with this ruling the appellant filed this appeal. The notice of appeal contained only one ground of appeal to wit:
