EKPE, JCA (Delivering the Leading Judgement): The proceedings leading to this appeal were commenced by F the plaintiff against the defendant by a writ of summons filed at the Calabar High Court of Cross River State in suit No. C/143/93. As articulated in paragraph 25 of the statement of claim which superseded the claim in the writ of summons, the plaintiff claimed the following reliefs against the defendant:-
“A declaration that the letter of termination dated 25th November, 1992 served on the plaintiff by the defendant is null and void and of no effect.
An order for reinstatement of the plaintiff.
Alternatively:
Special and general damages totalling up to N1,232,956.00 H for wrongful termination.
