ABBA BELLO MOHAMMED, JCA (DELIVERING THE LEADING JUDGEMENT): The Appellant/Applicant herein brought two motions on notice filed on 19th March, 2020 and 18th April, 2023 all seeking the leave of this Court to adduce further/fresh evidence in this appeal.

MOTION FILED ON 19TH MARCH, 2020:

In the first Motion filed on 19th March, 2020, the Appellant applicant sought for leave to adduce the following additional evidence:

(i) A letter from the Economic and Financial Crimes Commission to the 1st Respondent dated 19th April, 2005 which provided a report on its investigation on the petition by the 1st Respondent against Union Bank Plc to which was attached EFCC’s legal opinion to the effect that there was insufficient evidence to prove the allegation in the Petition. (“Exhibit CBN – AA”).

(ii) The 2nd Respondent’s cover letter dated 5th July, 2005 forwarding the original cheque leaf of Barclays Bank Cheque No. 010140 with the face value of £2,556,000,000.00 (Two Billion, Five Hundred and Fifty Si…
