(Delivering the Leading Judgment): The Appellant (the Defendant at the Court below) being aggrieved has appealed against the Judgment of the National Industrial Court of Nigeria delivered by Hon. Justice O. A. Shogbola on May 19th 2015, wherein the Court set aside the dismissal of the Respondent (the Claimant at the Court below). The brief facts that culminated into this appeal as found in the Record before this Court according to the Respondent who was an employee of the Appellant were that he started a mini co-operative forum where funds pooled together by the members were invested in various businesses.
