RULING
I am asked in the Motion on Notice brought under rule 4 of the rules of this Court amongst other provisions of law to grant leave to the applicants to lodge notice of appeal and memorandum of appeal from the judgment of Wakiaga, J delivered on 16th, July, 2012, in Nyeri Succession Cause No. 601 of 2006 out of time and to make such further orders as it may deem fit in the interests of justice. The Motion is supported by the affidavit of Charles Maina Mwangi, one of the applicants, who depones on his own behalf and on behalf of the other ten (10) applicants. He says amongst other things that they had filed an application to revoke grant in High Court Succession Cause No. 601 of 2006 which application was heard and dismissed; that they were represented by a lawyer who they instructed to file an appeal but that he did not do so; that his mother and brother were taken ill as is shown in medical documents annexed to the Motion and that the 2 sick people had hitherto been involved in m…
