JAMES GAMBO ABUNDAGA, JCA (Delivering the Leading Judgment): This is an appeal against the Ruling of the customary court of Appeal, Kaduna State in Appeal No: CCA/KAD/31A/M2/2010, Coram: Justice Barde Wakili, Justice Rifkatu Erica Nmadu, and Justice Linda Amina Yaroson delivered on 29th November, 2018.
The ruling was predicated on the motion filed by the appellants herein who were applicants in which the following reliefs were sought against the Respondents herein.
The Reliefs
AN ORDER directing the Respondent Banks, Fidelity Bank Plc and First City Monument Bank Plc, respectively, to forthwith pay/release to the Applicant the monies in Accounts Nos. 6051260900, 5620017468 and 3187622017 belonging to Late Christian C. Chinanuife (the deceased) and his company, sequel to the judgment of this honourable court delivered on the 28th day of September, 2018.
AN ORDER directing the Fidelity Bank Plc to also forthwith pay/release to the Applicant, the money in the Joint Account No. 5630095687…
