ABBA BELLO MOHAMMED, JCA (DELIVERING THE LEADING JUDGEMENT): This is an appeal against the judgment of the High Court of the Federal Capital Territory, Abuja (the trial court), coram: Hon. Justice Salisu Garba, delivered on 28th March, 2014 in Suit No. FCT/HC/CV/1051/2004. Before the trial court, the Respondent, as claimant, sought the following reliefs against the Appellants:

a. A declaration that the Plaintiff is the beneficial owner and holder of right of occupancy over Plot 203B situate in Kubwa Village.

b. An order of perpetual injunction restraining the Defendant, their servants, privies, assigns or any one claiming through them from selling, advertising for sale, trespassing, developing, building on, or dealing in any manner with the parcel of land known as Plot 203B situate at Kubwa Village, Abuja.

c. N500,000.00 being exemplary damages.

d. N200,000.00 being special damages.
