KALGO, J.C.A. (Delivering the Lead Ruling): This is an application for bail pending appeal. The application which was filed in this court on the 2nd of February, 1990 together with an Affidavit of Urgency, was praying for:

"AN ORDER admitting the appellant/applicant to Bail pending the determination by this court of his appeal filed on the 8th January, 1990 against the judgment of AYORINDE, Ag. C.J. of the High Court of Lagos State delivered on the 4th of January 1990 convicting and sentencing him to 12 months' imprisonment.

AND for such further or other orders as this Honourable Court may deem fit to make in the circumstances."

The application which was made pursuant to section 29(1) of the Court of Appeal Act, 1976, was supported by an affidavit of 27 paragraphs sworn to by Mrs. Bukun Fawehinmi, the wife of the applicant. A further affidavit of 3 paragraphs was later sworn to by one Osagie Obayuwana and filed on the 7th of February, 1990. The respondents filed a counter-affidavit of 5 …
