This appellant was convicted in the Rombo St. Mary Magistrate's Court of the offence of parking a motor-vehicle without a light contrary to Regulation 32 (1) of the Motor Traffic Regulations, 1955. He was fined £5 and disqualified from holding a driving licence for six months. He now appeals against the sentence. The case was tried by the Magistrate under the provisions of the Trial of Petty Criminal Cases Ordinance, c.25. It has already been held in this court in the case of Chief Superintendent of Police v. Sankareh that an order for disqualification cannot be made in the case of a trial under this Ordinance and the appeal, so far as the disqualification is concerned, must succeed on that ground alone.
There is another ground, however, upon which the disqualification cannot be supported in this case. By section 86 (1) of the Motor Traffic Ordinance, c. 155, the power to disqualify is limited to:
