MUHAMMAD, J.C.A. (Delivering the Leading Judgment): In this appeal, Kemi Pinheiro Esq for the respondent donated a fine brief of argument to us. It is particularly a parting gift to me as the appeal is one of those we shall be determining before my departure to the Port Harcourt Division of the court on transfer after a rewarding three years stint in the Lagos Division. Mr. Phinheiro's brief has been commendably simple and enjoyable to read with the succinct and resolute treatment of the issues therein addressed.
I came across many of such briefs during my stay in the Lagos Division from other counsel too numerous to mention here. I am grateful that I met and learnt from each and every one of the lot.
