JAMILU YAMMAMA TUKUR, J.S.C. (Delivering the Lead Judgment): The appeal is against the judgment of the Court of Appeal, Enugu Division, delivered on 25th September 2020 in Appeal No. CA/E/123C/2018 wherein the conviction and sentence of the Appellant to death for murder by the High Court of Ebonyi State was affirmed.
The facts of the matter which culminated in this appeal arose from the arraignment of the Appellant along with another on 20th June 2013, for the offence of murder of one Monday Moses Ovu Uwunna contrary to Section 319(1) of the Criminal Code Law Cap 33 Laws of Ebonyi State of Nigeria 2009, before Honourable Justice Destina O. Oko of the High Court of Ebonyi State. Upon conclusion of trial, the trial Judge found the Appellant guilty as charged and consequently sentenced the Appellant to death by hanging.
