HAMMA AKAWU BARKA, J.C.A. (Delivering the Leading Judgment): The instant appeal is against the interlocutory decision of the Federal High Court, Abuja, delivered on the 6th of March, 2025, whereof the lower Court refused to grant the Appellant bail pending trial.

It should be recalled that Appellant, as 1st defendant before the lower Court, was arraigned on a four-count charge bordering on possession of hard drugs contrary to the provisions of the National Drug Law Enforcement Agency Act Cap 30 Laws of the Federation of Nigeria on the 31st of May, 2024.

Consequent to the above, Appellant on the 13th of January, 2025, by way of an application brought by way of motion on notice pursuant to the provisions of Section 158 of the Administration of Criminal Justice Act, 2015, Sections 35(4) and 36(5) of the Constitution of the Federal Government of Nigeria 1999 as amended, and under the inherent jurisdiction of the Court, prayed for:
