DANLAMI ZAMA SENCHI, J.C.A. (Delivering the Leading Judgment): This appeal is against the judgment of the High Court of the Federal Capital Territory, Abuja in Suit No. FCT/HC/CV/4494/2012 delivered on 8th day of February, 2018 by Hon. Justice O.O GOODLUCK (as he then was).
The Appellant (as plaintiff) before the trial Court claims against the Respondents (Defendants) as follows:-
a. A Declaration that the contract of outright sale of Shop No. B2-301 at Dei-Dei Building Materials Market, Abuja between the Plaintiff and the 1st Defendant entered into on the 22nd day of March, 2007 is legal, valid and binding on both parties.
b. A declaration that the purported refusal of the 1st defendant to accept the final and full balance payment of N1,500,000.00 after collecting part payment of N200,000.00 from the Plaintiff for the outright sale and transfer of title of shop No. B2-301 at Dei-Dei Building Materials Market Abuja is illegal, null, void and in bad faith.
