GALADIMA JCA (Delivering the Lead Ruling): The 1st respondent in this appeal was the petitioner (sic) under the platform of theAll Progressive Grand Alliance (APGA) who contested election into the State House of Assembly held on 3/5/2003. He filed petition on 2/6/2003 challenging the return of the appellant/applicant of the Peoples Democratic Party (PDP). The Tribunal delivered judgment on 15/12/2003 declaring the petitioner as duly elected into Anambra State House of Assembly representing Njikoka I Constituency. Dissatisfied with the decision, appellant filed notice of appeal on 18/ 12/2003 originally carrying five grounds of appeal.
