(Delivering the Leading Judgment): This is an appeal against the judgment of the Adamawa State High Court of Justice, Yola division (hereinafter referred to as “the Court below”) Coram: AHMED ISA, J. delivered on the 15th day of January, 2024 in Suit No. HC/ADSY/179/2022 wherein the Court granted the Respondent’s reliefs against the Appellants. See pages 78-95 of the records.
By this appeal, the Appellants have sought to set aside the decision of the Court below on the ground that it erred in dismissing the application for leave by the Appellants to file their Joint Statement of Defense out of time instead of striking it out, which then breached the fundamental right of the Appellants to fair hearing. The Appellants also sought by this appeal, to set aside the decision of the Court below on the ground that the Respondent did not establish the existence of a valid contract between the Appellants and Respondent.
