NONYEREM OKORONKWO, J.C.A. (Delivering the Leading Judgment): By a judgment of the Oyo State High Court delivered on 25th March, 2014, the trial Court per A.A. Sunmonu (Judge) granted the application of the respondent for the enforcement of their fundamental rights under Section 34, 35 and 36 of the 1999 Constitution (as amended) in terms of the reliefs claimed except that damages claimed were reduced.

The reliefs claimed are as shown on page 14 of record as follows:

1. A Declaration that the arrest and detention of the Applicants on the 20th day of May, 2013 by the Officers of the 1st and 2nd Respondents, and especially the 3rd Respondent and at the instance and prompting of the 4th to 10th Respondents without any warrant of arrest to that effect or a commission of any offence by the Applicants from about 10 a.m. to 9.00 p.m. is a violation of the Applicants fundamental rights to liberty, freedom of movement and fair hearing as enshrined and protected under Sections 34, 35 and 36 of th…
