(Delivering the Lead Judgment): This appeal is against the judgment of the Court of Appeal Abuja Division, delivered on the 24th day of November, 2022, setting aside the conviction and sentence to death of the Respondent by hanging delivered by the Federal Capital Territory High Court Abuja on the 25th day of March, 2015 upon finding the Respondent guilty of conspiracy and armed robbery contrary to and punishable under Section 1 (2) (a) of the Robbery and Firearms (special Provisions) Act Cap R.11. and having a locally made pistol without licence.
Just by way of settling the facts grounding this appeal, the Respondent, along with two other persons, negotiated with PW1, who was driving a red Toyota Starlet, to transport them from the AYA bus stop in Asokoro, Abuja, to the Mpape bus stop.
